Policy Statement Concerning Public Nudity and Sexually Offensive Conduct

The University of California at Berkeley has a tradition of informality and tolerance. It is necessary, however, to emphasize that lewd or sexually offensive conduct, including indecent exposure and public nudity, is not permitted on the Berkeley campus. This conduct may also constitute a violation of the campus Code of Student Conduct and state criminal law.

This policy applies to all public areas of the campus including offices and classrooms (except for specifically designated “clothing optional areas” of campus gymnasiums and pools), and to all persons, including students, employees, and visitors (except for babies and young children).

This prohibition does not apply to individuals or groups participating in appropriate visual or performing arts productions or academic programs or classes scheduled or sponsored by campus academic units or departments, as determined and formally approved by the departmental chair or unit director. Whenever possible, members of the public should be appropriately informed that nudity may be included in a performance.

Complaints regarding this policy should be brought to the attention of the campus police department, 1 Sproul Hall, the campus sexual harassment officer, 226 California Hall, or the Office of Student Conduct, 326 Sproul Hall.
